GENERAL TERMS AND CONDITIONS OF BREEDING CONTRACT
- The booking fee for the stallion Sonajero XI is $200 inc GST. The booking fee is non-refundable and is to be payable upon booking being received and acknowledged by way of receipt from Caballo Park.
- The service fee for the stallion Sonajero XI is $2000 inc GST. The service fee is payable upon positive result of U/S Scan (30 days after service) unless otherwise stated.
- This contract shall not be transferred or assigned, and in the event that the mare is the subject of a transfer of ownership, or is consigned for sale, the service fee shall become immediately due and payable within 14 days of written notice to that effect being served on the mare owner.
- If the stallion shall in any way become unfit for service before servicing the mare, or if the mare should die or become unfit for service (as provided in a veterinary certificate) this Contract shall become null and void.
- Payment other than service fee is due by the mare owner to the stallion owner within 7 days of any amounts being invoiced in accordance with this Contract. Interest at 7% p.a. may be charged by the stallion owner on any unpaid amounts.
- The stallion owner and the mare owner agree that the stallion owner shall not be liable, nor responsible in any manner for any disease, accident or injury to the mare or any foal, whether such disease, accident or injury is a result of the negligence or action of the stallion owner or otherwise. The mare owner acknowledges that the mare enters the premises of the stallion owner entirely at the risk of the mare owner.
- Multiple mare discounts. The first breeding will assess full stallion service fee. The second mare will receive 10% discount on service fee. Three or more mares will receive 15% discount on service fee.
- In all cases veterinary and farrier charges are the responsibility of the owner of the mare. The stud reserves the right to call the veterinarian at any time for any reason which in the opinion of the stud is in the best interests of the agisted mare/foal. Any veterinary bills will be invoiced to and sent directly to mare owner for payment.
- All mares must have shoes removed prior to arriving at the stud for serving.
- All owners must produce a Pre-mating swab certificate taken within one week of the mare arriving at the stud, whether maiden or not, or the stud will obtain same at your cost.
- Agistment costs are as follows: *

- Agistment for the mare must be paid within seven days of receipt of account. The mare will not be released from the stud to the owner until all agistment charges are paid. Agistment accounts will be issued weekly.
- The stud undertakes to ensure all reasonable care, but no responsibility for any mare, foal or weanling is borne by the stud. The stud agrees to undertake to notify the owner of any injury or disease suffered by the mare of foal as soon as is practicable. Insurance is the sole responsibility of the mare owner.
- LIVE GUARANTEE If the Mare Owner's mare is barren, aborts or fails to produce a single live foal that can stand up unassisted and nurse, Stallion Owner will allow Mare Owner a return breeding privilege of the Mare to Stallion (or a substitute mare if acceptable to Stallion Owner) in the next breeding season only, to the same Mare, provided that Mare Owner furnishes a satisfactory certificate issued by a qualified veterinary surgeon attesting to either occurrence within seven (7) days of the date of the occurrence. An additional booking fee, in the amount set forth within paragraph 1,and agistment fess as set out in paragraph 11, must be paid for each re-breed conducted after the year of initial service.
- The stud warrants to have the mare ready for collection by the owner, based upon a positive result from an U/S Scan taken at 16 days and 45 days after date of last service, this will be confirmed with the issue of a 'Certificate of examination for pregnancy' showing a positive result and signed by a qualified veterinary surgeon. Should the stud not be able to produce this result in a time frame deemed reasonable by the Stud Manager, the service fee shall be waived. (The Booking Fee and Agistment costs and other outstandings remain payable before pickup of mare).
- Caballo Park reserves the right to decline any mare after arrival for serving, if the stud deems any aspect of the mare unsuitable eg temperament, reproductive capability, type, foaling history etc.
